Implementing MHP in a set-top box, IDTV or other receiver involves a number of steps, both the ensure that the implementation is technically correct and will operate in the markets at which it is targeted, but also to obtain the right to use the MHP logo on pieces of consumer equipment.

The MHP standards are largely based in Java™. special arrangements with Sun Microsystems, the main technology provider of Java.

 
 

Implementation and Conformance Arrangements

The definitive guide to the legal and conformance arrangements surrounding the MHP specification, including the procedure for obtaining the right to use the MHP logo, is DVB BlueBook A066r1.

MHP Patent Pool

Under the IPR policy of the DVB, members agree to license IPR essential to DVB specifications on terms fair, reasonable and non-discriminatory, (except for those IPRs for which it gives notice that it has no right to license). The DVB also fosters the formation of voluntary joint licensing regimes. It is, however, for the rights holders, and not for DVB, to specify the royalty rate and other terms of these pools. More information on the DVB's IPR policy is available on the DVB website. Note that the IPR policy of other standards bodies, for example ETSI, may also apply to a DVB specification.

In the context of MHP, our IPR policy has:

  • confirmed the availability of essential IPRs when no DVB member responded that its essential IPRs were NOT available on terms fair, reasonable and non-discriminatory;
  • overseen the completion of arrangements for conformance testing and licensing of Sun's essential IPR;
  • fostered the formation of a common licensing administration covering the other IPRs essential to MHP by naming a patent coordinator to review declarations of essentiality submitted by rights holders; and
  • convoked an initial meeting of successful declarants so that these rights holders could decide the next steps of the pooling effort.

This step concludes the DVB's involvement in the process.

Via Licensing Corporation makes available a worldwide joint license agreement for patents deemed essential to implementing MHP 1.0. Device manufacturers are required to pay a per-device fee. More information can be obtained directly from Via Licensing.

Using the MHP Logo

Only products that have passed the MHP Test Suite and fulfilled the requirements of the associated licensing arrangements may use the MHP logo. Just like DVB, MHP is a registered trademark of the DVB Project and is managed by the DVB Project Office. Use of the MHP trademark, both the name mark and the logo mark, are subject to a number of rules and require the approval of the DVB Project Office.

Use of the MHP logo in relation to a product is restricted to those products which have successfully completed the MHP Test Suite and have fulfilled all stipulations of the MHP Mark License Agreement.

Trademark Acknowledgement

When DVB and MHP trademarks are used in advertising and other promotional material, their ownership must be acknowledged. Please include the appropriate acknowledgement listed below.
