Step 1 - Review Specification

Implementing MHP & Testing This Implementation

If your company is considering implementation you will need to examine the MHP specification.

Here, the MHP specification refers to a specification or other document in which a third party, for example Sun Microsystems, has copyright. To aid implementers, a separate website has been established containing the referenced documents. These third party websites may have click though limitations.

There are no fees at this stage.

 


Step 2- Test Implementation

Using the MHP Test Suite and Other Source Code

a) Obtaining the MHP Test Suite

Send two copies, each signed, of each Test Application License and one copy of instructions relating to Further Test Applications for MHP Test Suite (only one available at this time). Review licensing terms. Make payment of € 1'000- administrative fee to ETSI (contact Gina Ebenezersson).

At this time there is no royalty.

b) Obtaining Additional Source Code & Test Harnesses

In addition to the Test Suite as mentioned under a), at your option, send ETSI two copies, each signed, of each Source Code License and of each Test Harness License. Review the licensing terms; there is no additional administrative fee and, at this time, no royalty.

 


Step 3 - IPR Licensing

Licensing IPR Essential to the Implementation of MHP

When you have completed conformance testing and your implementation successfully passes the MHP Test Suite, you can obtain from ETSI (as custodian), a license of IPR essential to the MHP specification held by Sun Microsystems.

There are several options for which licensing arrangement you choose to enter into:

1. Short-form license of essential IPR: Under the terms of the Essential IPR License offered by Sun, you as licensee agree not to bring any claims for infringement of your own IPR essential to the MHP specification. The potential licensee should review the licensing terms and send ETSI two copies, each signed, of each Essential IPR License. No royalty due.

2. Short-form, $1 patent license agreement: If you intend to seek a royalty from implementers based on your own essential IPR, you should contact Sun directly. Sun has indicated that in such cases it will assess you a royalty not to exceed US$1 for each hardware unit. In this case you should send two signed copies of the $1 Patent License Agreement to Sun and inform ETSI that you have signed the $1 Agreement with Sun (ebenezersson@etsi.org).

3. Long-form license with IPR holder: If you wish to go beyond the licensing arrangements set out in an Essential IPR License and enter into a broader arrangement with one or more licensors you should make direct contact with the licensor. Royalty and other terms are subject to bilateral negotiations. Send notice to ETSI of your licensing option (ebenezersson@etsi.org).

4. No license (Clean-Room Implementer): Indicate in writing to ETSI that you have chosen not to deliver an Essential IPR License (ebenezersson@etsi.org).

 


Step 4 - Market Launch

Getting a Product onto the Market and using the MHP Logo

Each implementer must send the Certificate of Completion of Conformance Testing to ETSI; it also sends two copies, each signed, of the MHP Mark License Agreement to DVB Project Office. A royalty of € 10.000- needs to be paid to the DVB Project Office.

Use of the MHP Mark is strictly governed by the DVB Project Office. Any uncertified usage of the MHP Mark on or in relation to MHP Implementations that could suggest compliance to the DVB-MHP standard is illegal and will be prosecuted.
